IBM hammer drops on SCO

They filed for summary judgement. Finally.

<a href="http://www.groklaw.net/article.php?stor ...

As paraphrased by a commentator:
Quote:
We didn't do it. Even if we did, these guys (AT&T, Novell) said we could, but we didn't. And even if we did, which we didn't, not only did these guys say we could (but we didn't), but these nobks (SCO) did the same thing, so we should be allowed to do it. Which we didn't.

The actual IBM memo is 100 pages. Forgot to post the follow-up to this the other day. This was posted a day or two after the first article.
<a href="http://www.groklaw.net/article.php?stor ...

This is where IBM shows a ton of evidence saying that SCO is illegally using and distributing their copyrighted code. And they delivered 750,000 specific lines for evidence. See, these copyrighted works are in Linux, which is distributed under the GPL. If SCO breaks or invalidates the GPL, it has no legal right whatsoever to use that code.

Therefore their only defense is to argue the validity of the GPL. This after they filed court documents saying it was unconstitutional.

PJ sez:

Quote:

They are asking for summary judgment as to liability and a permanent injunction.

Here's the lesson. You don't ever want IBM legally mad at you.

SCO and friends keep floating these rumors about SCO settling or being bought up. I think IBM has other plans, like crushing SCO like a bug.

BOOM, baby!

<img src=http://www.thzclan.com/forums/images/sm ... bounce.gif ALT=":bounce"> <img src=http://www.thzclan.com/forums/images/sm ... bounce.gif ALT=":bounce"> <img src=http://www.thzclan.com/forums/images/sm ... bounce.gif ALT=":bounce">

It may have the additional benefit of giving the GPL an actual legal test in court, which could set a nice legal precedent. I don't know that there's presently anyone better suited and supplied to argue the validity and merits of the GPL than IBM.

XMEN member
Card-carrying DTM
OKL Fish-napper

Though a program be but three lines long, someday it will have to be maintained.
The Tao of Programming
Edited by: <A HREF=http://p090.ezboard.com/bxmenclan.showU ... ambit>XMEN Gambit at: 8/20/04 4:49 pm
