Why is SCO v IBM taking so long?

Come in! Have a margarita or root beer? How about some fresh trout? :)

Why is SCO v IBM taking so long?

Post by XMEN Gambit »

I was reading Groklaw this morning and someone raised the issue of the judge being incompetent for letting SCO delay the issue for so long without showing any evidence. Someone posted an excellent reply to that, and I'll quote tidbits here:
In civil cases, you do not have to give proof until the END of Discovery. ... this is not a criminal case.

...SCO's attorneys are not dumb. They are fairly dangerous and talented in having extended this case this far despite having no evidence... SCO's attorneys have tried every legal trick in the book. This is why this case is so instructive for future generations of lawyers.

An important job Judge Kimball had was to avoid appeal. To do this, he had to give SCO a lot of slack...

Also note that this case is so long because IBM will not settle... [IBM] wants its Linux business completely and utterly cleared for all time.

It's smart of IBM IMO to let it go on, because they truly have a good case.
