Apparently Darl & co. are getting concerned enough about their chances to show it in public. He said they'd continue to survive even if they fail in court, though that's not what he's said in earlier interviews and the opposite is stated in their latest SEC filing.

Also, a SCO techie stated in a deposition that Linux kernel code was used in their LKP product, part of their UnixWare package, up through May of '03. So, wonder if that's where all the millions of lines of duplicated code was supposed to have come from, eh? Depending on how it was used, SCO may or may not have been required to open-source the rest of the product, or stop using the code, under its GPL license. But they certainly didn't disclose the fact they'd used it, which they ARE required to do.

I must say, the house of cards is beginning to crumble, and not before time. The question now is how much if anything will be left to pay damages from all the press releases, shooting off the foot in the mouth, and letters to Congress that they've got themselves into. The Novell motion I mentioned a few posts ago asks that the money they're owed for licenses be put in a trust until the case is decided, which would essentially leave SCO with zero operating capital.
